BBS Member Michele Turner and Firm's Municipal Team Win Defense Verdict

Congratulations to Member Michele Turner and the firm's municipal team on their recent defense verdict. The case involved a 39-year-old mother of 4 who claimed that our client, a parking enforcement officer, struck her with his work vehicle as she was attempting to cross the street. She had been at a corner market buying juice and snacks for her kids, who were waiting in her (illegally) parked car at 56th and Arch Streets in Philadelphia.

We argued that plaintiff was not in the crosswalk (which she admitted) and was rushing to get to her illegally parked car when she ran into the side of our client's work vehicle.

Plaintiff attempted to embellish her testimony by claiming that she saw that our client wasn't paying attention as she crossed the street. This led Michele to ask: "so, you saw my client not paying attention and you stepped out into the street anyway?"

Plaintiff's settlement demand was $750,000 and she had 44 months of chiropractic treatment, physical therapy, a median branch block and a radiofrequency ablation. Through her future medical costs expert, she estimated that the cost of her future medical care would be $250,444.

The jury deliberated for only 40 minutes (through lunch) and only answered the first question finding that our clients were not negligent!
