Stephen Trzcinski Secures Appellate Victory in Procopio v. Eichle

We are proud to announce that our Of Counsel Stephen Trzcinski secured a decisive appellate victory in Procopio v Eichle, No. 2022-00757, 2026 N.Y. App. Div. LEXIS 2799 (2d Dep’t 2026). Representing the third-party defendant, Stephen successfully advocated for the affirmance of summary judgment in a complex Dram Shop and premises liability action stemming from a physical altercation between the plaintiff and our client.

In a unanimous decision, the Appellate Division, Second Department, held there was insufficient evidence of illegal alcohol service to minors. The Court further determined the plaintiff failed to establish that an allegedly icy sidewalk caused or contributed to his fall, rendering the premises liability claims speculative. This result successfully insulated our client from liability by extinguishing all third-party claims in tandem with the primary action.
