Jim Blumenthal Secures Favorable Jury Verdict in Union County Personal Injury Trial

BBS Member Jim Blumenthal represented and defended a school district in a personal injury lawsuit trial in Union County, New Jersey. A school custodian was driving a truck while he was working and struck a 16-year-old student in a crosswalk as she was on her way to school. The defense conceded liability and the case was defended on damages. The plaintiff suffered a fractured and displaced tibia, underwent an ORIF and titanium rod insertion, and a broken ankle with surgical screw placement. At the trial, the orthopedic surgeon who performed the surgeries testified on behalf of the plaintiff, along with a plastic surgeon who testified concerning the plaintiff’s lower extremity scarring. We presented Title 59 defenses at trial and argued that the plaintiff did not suffer a permanent loss of body function in accordance with the statute’s requirements. The jury agreed with the defense’s argument and returned with a unanimous verdict of zero dollars for pain and suffering and $11,500 for the plaintiff’s future medical expenses for scar revision.
