Favorable Trial Result in Middlesex County in Premises Liability Case

BBS member, Jim Blumenthal defended a premises liability matter in Middlesex County, New Jersey. He represented and defended a company whose job it was to clear snow and ice from commercial facilities. The plaintiff claimed he slipped and fell on certain premises, injuring himself, and requiring a hip surgery with the insertion of screws that then failed and required a total hip replacement. The allegation was that the company improperly salted the location causing the plaintiff’s fall and surgeries. At the conclusion of the trial, the jury found 51% liability on the defendant and 49% on the plaintiff, and the gross award for the plaintiff was only a fraction of the demand and far less the policy limits. The gross verdict was less than had been offered by the insurance carrier for the snow removal company. Congratulations Jim!
