Led by Daniel Moraglia, Michael Saltzburg and Beth Carter, the automobile team has handled virtually every aspect of automobile litigation, including liability, uninsured and underinsured motorist, and first-party benefits cases in a number of courts. Additionally, the firm regularly provides its automobile insurance clients with advice on coverage issues.
The firm's history of automobile litigation reaches back to the origin of the firm and continued under the No-Fault Act and now under the Pennsylvania Motor Vehicle Financial Responsibility Law. With the passage in 1990 of the Act 6 amendments to that law, the firm demonstrated its commitment to client education by holding a series of seminars designed to educate insurance company personnel not only on the changes in the law but also on the impact of Pennsylvania's new "bad faith" statute on the handling of automobile claims. That commitment to education is more evident than ever today, as the firm's attorneys and particularly members of the automobile team provide continuous updates in the form of "Companies in Interest" letters to clients and hold periodic seminars on issues of interest to claims handlers and insurance company management.
The firm was one of the first in the Philadelphia area to try jury cases under the limited tort standard and has successfully defended a large number of those cases. Those cases are routinely challenged on a motion basis at the close of discovery, and a substantial number of cases have been ended summarily in this way. With offices in both Philadelphia and New Jersey, the firm's attorneys have become well versed in the large number of legal issues which arise from motor vehicle accidents involving residents of these two states. Several appellate and trial court opinions clarifying the law in this field have been the result of the firm's advocacy.
